The increasing use of electronic components in vehicles, highly complex braking systems, and other safety-relevant technology, in particular, requires a high level of training and continuing education for repair shops, as well as the use of technical information provided by the manufacturer.

Certain work on vehicles may only be carried out with specially manufactured tools. It does not always seem certain that the workshops designated by insurance companies actually possess this equipment.

Therefore, every driver involved in a traffic accident is advised not to rely on advice from the other party's insurance company, but to take charge of the accident claim process themselves, together with their trusted repair shop. The advice of an independent automotive expert and, of course, a traffic law attorney can be helpful in this regard.

According to established case law, the injured party is generally entitled to reimbursement of the hourly rate and thus to reimbursement of repair costs at an authorized dealership. An obligation to use a less expensive repair option only exists if the alternative is equivalent in every respect. This includes, among other things, the less expensive repair shop being able to demonstrate that it possesses the necessary technical equipment and is brand-specific trained. Naturally, it must also be ensured that warranty and goodwill claims are not forfeited.

As a rule, such proof will not be possible.
